Frequently asked questions

Plain answers to the questions people most often ask when HMRC gets in touch.

Why has HMRC opened an investigation?

HMRC can open enquiries for many reasons. The existence of an investigation does not by itself establish that anything is wrong. The first step is understanding the scope of HMRC's enquiry and reviewing the underlying tax position.

Should I answer HMRC myself?

You can respond yourself, but an investigation can have consequences beyond the question contained in the first letter. Specialist advice can help you understand the wider context before responding.

Can TaxResolve speak to HMRC for me?

Once formally appointed and appropriately authorised, we can deal with HMRC on the tax and accounting aspects of your case.

Do I need to change accountant?

No. TaxResolve can deal specifically with the investigation while your existing accountant continues to handle your normal accounts and tax returns.

What if my accountant made the original mistake?

The facts need to be reviewed before responsibility is assumed. We can independently examine the historic treatment and work with your existing adviser where appropriate.

How long does an HMRC investigation take?

There is no single timeframe. It depends on the scope of the enquiry, complexity of the issues, quality of the records, speed of responses and whether areas remain disputed.

Can HMRC charge penalties?

Penalties can arise in some circumstances. The position depends on the underlying facts and applicable rules. TaxResolve can review both the tax position and any penalty proposed.

What if I know something on a previous tax return was wrong?

Obtain advice before deciding how to correct it. Different disclosure routes may apply depending on what happened and the taxes involved.

What is COP9?

Code of Practice 9 is used by HMRC in selected cases where tax fraud is suspected. It is a serious process and specialist advice should be obtained promptly.

Can you help if HMRC is wrong?

Yes. Where the evidence and tax position support it, we can challenge HMRC's assumptions, calculations or conclusions and assist with the available dispute process.
